This composite image shows a superbubble in the Large Magellanic Cloud (LMC), a small satellite galaxy of the Milky Way located about 160,000 light years from Earth.

Many new stars, some of them very massive, are forming in the star cluster NGC 1929, which is embedded in the nebula N44, so named because it is the 44th nebula in a catalog of such objects in the Magellanic Clouds. The massive stars produce intense radiation, expel matter at high speeds, and race through their evolution to explode as supernovas. The winds and supernova shock waves carve out huge cavities called superbubbles in the surrounding gas.

X-rays from NASA's Chandra X-ray Observatory (blue) show hot regions created by these winds and shocks, while infrared data from NASA's Spitzer Space Telescope (red) outline where the dust and cooler gas are found. The optical light from the 2.2-m Max-Planck-ESO telescope (yellow) in Chile shows where ultraviolet radiation from hot, young stars is causing gas in the nebula to glow.

A long-running problem in high-energy astrophysics has been that some superbubbles in the LMC, including N44, give off a lot more X-rays than expected from models of their structure. These models assume that hot, X-ray emitting gas has been produced by winds from massive stars and the remains of several supernovas. A Chandra study published in 2011 showed that there are two extra sources of N44's X-ray emission not included in these models: supernova shock waves striking the walls of the cavities, and hot material evaporating from the cavity walls.

The Chandra observations also show no evidence for an enhancement of elements heavier than hydrogen and helium in the cavities, thus ruling out this possibility as a third explanation for the bright X-ray emission. Only with long observations making full use of the capabilities of Chandra has it now become possible to distinguish between different sources of the X-rays produced by superbubbles.

The Chandra study of N44 and another superbubble in the LMC was led by Anne Jaskot from the University of Michigan in Ann Arbor. The co-authors were Dave Strickland from Johns Hopkins University in Baltimore, MD, Sally Oey from University of Michigan, You-Hua Chu from University of Illinois and Guillermo Garcia-Segura from Instituto de Astronomia-UNAM in Ensenada, Mexico.

One Year - what I've learned - SoberRecovery : Alcoholism ...

First off, thank you to everyone on this forum. Especially Dee and Carol for running the show. Reading the threads daily has been part of my plan, and has been very helpful.

I haven?t had a drink in a year.

Was it hard to not drink? The act of ?not drinking? was easier than I thought. I never came close to breaking and actually having a drink. But everything else involved in being someone who ?quit drinking? was much harder than expected. I?ve been forced to face things I?ve avoided, and I?ve had to relearn how to have fun without drinking.

Will I drink again? Forever is a long time and it?s hard to get my head around it. What I can say with certainty is that I won?t drink today, I won?t drink this week, and I won?t drink this month. The old drinking devil does pop up and says ?you?ll be back?. I don?t think that devil will ever go away, but I've learned how to keep him in his cage.

I know for a fact that with my biology, I?m either a non-drinker or a heavy drinker. There is no in between. An absolute truth for me is that it was no fun to try and control my drinking, and if I had fun drinking, I was out of control. If I only had 2 or 3 drinks, I could stop ? but I wanted more. If I drank all I wanted, I would end up out of control. Both of those outcomes were bad, and I?m glad I haven?t had to endure the torture of the first and the terrible consequences of the second.

I?ve become much more genuine over the last year. I?m a better husband, friend, and employee. I don?t have to deceive people about my drinking or deal with all the hassles of getting a drink, making sure I have enough to drink, sneaking drinks, or lying about being drunk.

There are many many things that are better in my life since I quit.

? I?m authentic. I act, talk, and think in a way that is real.
? I?m a better husband and partner for my wife.
? When we talk, we have better conversations and I remember all of them.
? She knows I?m sober, so she knows she?s talking to the real me and not the drunk me.
? I don?t run the risk of embarrassing her, which makes both of us relax.
? I don?t make her feel alone, even when I?m there.
? I don?t have to lie to my wife about how much I?ve had to drink or conceal my drinking.
? I don?t drive drunk (or near drunk) and put us at risk or make us feel uncomfortable.
? Other people don't drink very much. It's remarkable how little normal people actually drink.
? Other people really don't care that you quit. They are doing their own thing, and could mostly care less if you're having a drink at the party or dinner.
? I am much sharper and quicker
? I am way funnier. It?s not even close. I can think of jokes quickly, deliver them well, and can go close to the line without going over it.
? I don?t get tired or hung over after a night of drinking. Sunday?s are more active.
? I feel great on Monday and Tuesday instead of just getting by and regaining energy
? Mornings are now the best time of day. I?m alert and in a great mood.
? My patience is 10X better. This may be the best thing of all. Things just don?t bother me and I?m much calmer.
? At work, I?m a better manager and employee because I?m sharper, more energetic, and more patient.
? Socially, I am more willing to speak my mind and take risks in conversation or jokes because I don?t have my ?you?re drunk. Don?t say something dumb? governor on.
? I?m becoming less selfish and self absorbed.
? I?ve lost 30 pounds. I eat whatever I want and I don?t exercise.
? My skin, eyes, and face look better.
? I don?t get blurry vision
? My body functions better ? it just feels less creaky
? No more debilitating stomach aches.
? Brain fog is gone. I?m always clear.
? Recall is better ? not 100%, but definitely improved.
? I always tell the truth because I have nothing to hide. I used to have little meaningless deceptions. Those eroded my soul and hindered my relationships.
? I see the rest of the drinkers in my family and I don?t want to be them.
? I?m proud of my discipline and growth which make me feel better about myself and more hopeful.
? I?m a better friend because I?m more real, attentive, and they know I?m not drunk.
? I don?t have to hide my drinking, or hide the purchase/disposal of bottles.
? I?m not itching for more or monitoring how much is left or how I get my next one.
? Dinner is waaay less expensive.
? I?m learning to focus on and enjoy the present, rather than ruminating on the past or worrying about all the scenarios that could occur in the future.
? I don?t have to sober up at the end of the night. The last 3 hours felt like a waste because I wanted to drink but couldn?t. It was a little depressing and tiring, and I?m glad that?s gone.
? My wife doesn?t have to ask ?are you okay to drive?. And I don?t have to lie to her and have her know it and resent me for the risk and the lie.
? Emotions are real rather than being initiated by being too drunk.
? I?m not overenthusiastic in conversation which I think is real, but the person I?m talking to knows is not genuine.
? My family and close friends are proud of me. They don?t have to say it, but they all knew I was drinking too much and they notice that it?s good that I stopped.
? It doesn?t take 2 drinks for me to feel ?normal?.
? I don?t fall asleep in movies because I had too much to drink.
? I don?t dominate dinner parties with loud conversation. I have the right balance now.
? I know that my brain is healing itself. I can feel it and see it in my thoughts and actions.
? I have more energy and enthusiasm for the little chores. This makes me more responsible, more on top of things, and helps my wife relax because things are getting done on time.
? I maintain my position in arguments with my wife because she can no longer ?play the ace? against me. I do it nicely, but am not a push over because I don?t have fear of her somehow relating the disagreement to my drinking.
? I look people in the eye and hold my gaze longer. I?m not sure why I do this now, but I find myself doing it. This definitely displays more confidence.

Everyone is different, but these are my experiences and observations. These positives are the benefits of change and motivators to maintain the change and not drink.

It was also during this era that the companies responsible for manufacturing hats and jersey took a big step up in terms of the quality of apparel they produced. Over the last fifteen years, the sport apparel business has continued to grow and thrive as fans become even more involved with following and supporting their teams. The internet too has helped take the business of sports apparel to the next level as fans can now shop online for NFL Jersey, caps, and the like even during the off season. Where this business goes from here is anybody guess, but if I where to guess, I guess the sports fans will drive it up and help it grow larger.

Constitution Check: Is the GOP aiming to bar all abortions?

checkLyle Denniston examines the GOP platform?s desire for human-right-to-life measures, and if it can be accomplished through an amendment to the Constitution.

The statements at issue:

?The unborn child has a fundamental individual right to life which cannot be infringed.?? We support a human-right-to-life amendment to the Constitution and endorse legislation to make clear that the Fourteenth Amendment?s protections apply to unborn children.?

? Proposed national Republican Party platform language dealing with abortion issues, as written on August 21.

?James Bopp says that the Republican platform does not endorse an abortion ban without any exceptions?.? We don?t set out exceptions because we don?t want to get into a debate over which version is appropriate,? said Bopp, co-chairman of the Republican party platform Subcommittee on Restoring Constitutional Government.? ?The issue is restoring legal protection for the unborn.? We?re in favor of that concept, but not a particular amendment to do so.? ?

? Remarks attributed to Mr. Bopp by Sarah Kliff, Washington Post reporter, in an August 24 story, ?Did Republicans actually endorse a full abortion ban? Maybe not.?

We checked the Constitution, and?

No words in the Constitution are self-enforcing, so amendments to that basic document will come to have real-world meaning only as individuals and institutions test the words and the courts and legislatures react.? If the wording about ?unborn children? that the national Republican Party appears ready to endorse at its Tampa convention this week were to become the law of the land, at the very least it would bring a new, uncertain legal relationship between pregnant women and their fetuses.

Even the most direct constitutional language does not have absolute meaning.? For example, the First Amendment says that there shall be ?no law? infringing freedom of speech or of the press.? But ?no law? obviously has not meant ?no law,? because there are laws of libel and privacy, for example, and they clearly are constitutional.

Right now, the constitutional law regarding abortions means what the Supreme Court has said: A woman has a qualified right to end pregnancy, at least up to a point in pregnancy, and that right is more definite if the woman and her doctor agree that an abortion is medically necessary, for the woman?s life or for her physical or mental health.? The fetus has rights to potential life, but those are far less precisely defined as of now, but it is clear that the Supreme Court has refused to acknowledge that a fetus is a ?person? in a constitutional sense.

The proposed GOP platform language would seek to change the current status of abortion law in two ways ? one constitutional, one legislative.

A new constitutional amendment would for the first time declare that a fetus has a ?fundamental right to life.??? If a right is ?fundamental,? the Supreme Court has made clear, it must be protected unless the government can show that a law to restrict it is close to absolutely necessary to serve a ?compelling? government policy.

One question for courts and legislatures to answer, with that new amendment in force, would be how to balance the interests of the pregnant woman and those of the fetus she is carrying, and how that balance might be tipped one way or the other by circumstance.?? Would that set up an inevitable legal conflict between the woman and the fetus?? Possibly, but not necessarily.

Another question would be whether the amendment?s protection for the fetus is greater if the pregnancy moves into the middle or later weeks.? In fact, the interest of the fetus, even under existing law, is said to grow in importance the nearer the pregnancy is to full term and fetal survivability grows.

And still another question would be what reasons of physical or mental health of the pregnant woman would allow an abortion even at the cost of the life of the fetus.?? Would pregnancy resulting from rape or incest qualify?? Would only a threat to the life of the mother qualify?

People with opposing views on abortion rights have already weighed in with their interpretations of what such a ?human life amendment? would actually mean.? But no one can know for sure unless the amendment actually gets put into the Constitution, and is then applied.

The GOP platform?s second approach appears to be a plea only for a new law or set of laws, not another constitutional amendment.? Such a law apparently would interpret the word ?person? in the 14th Amendment to include the fetus.? As such, the fetus?s life could not be extinguished ?without due process of law? and the fetus could not be denied legal equality.

If anything, such a law might raise even more questions about the real-world effect on abortions than would a proposed constitutional amendment to recognize a right to life.?? When could extinguishing the fetus?s life qualify as the result of ?due process of law???? To whose rights would the fetus?s legal rights have to be equal??? Would that inevitably mean a balancing of fetal rights with the pregnant woman?s rights?? And how would such a balance work out in practice?

Here, again, the answers cannot be known in advance.?? So, in actuality, the GOP platform essentially would embrace a change in constitutional thinking, but would otherwise be an experiment that could take differing paths as it unfolded in the future.

Business Ethics Memo: Liestrong?

Lance Armstrong's sponsors, including Nike, Oakley, Anheuser-Busch InBev, and FRS energy drinks, have decided to continue to back him. This shows an embarrassing lack of business-ethical leadership across the board.

The doping case against Armstrong is overwhelming, including numerous prominent eye-witnesses and even blood samples, though technically beyond the date of expiration. Courts of law take eye-witness testimony into account so there is nothing unreasonable about doing so here. Indeed, given how easily a champion can manipulate the drug tests, it is often the only way the rules can be enforced.

I suspect that when Tyler Hamilton's damning book comes out next month "The Secret Race: Inside the Hidden World of the Tour de France: Doping, Cover-ups and Winning at All Costs",?it will deepen the debate in this country and begin to embarrass Armstrong's sponsors to an intolerable extent. It's only normal for the initial American reaction to be one of denial given how hard Armstrong has fought these charges for so many years, along with being not only cycling's greatest champion but also a major force against cancer.

Still, this gloss must wear off eventually.

Indeed, his own fight with cancer becomes tarnished by the possibility that his doping was a causal factor in his contracting the disease to begin with.

When such high-profile sponsors as these double down on denial, it allows the rest of his supporters and other athletes to continue living a lie. It turns blind eye to the damage doping does to athletes already under intense physical and psychological pressure. As Hamilton's book will describe in chilling detail, this atmosphere pushes many to substance abuse, depression and even suicide.

Corporations that ultimately depend on these athletes have a responsibility to do whatever they can to protect them from the pressure to dope. The least they can do to encourage cyclists not to engage in that practice is to drop their sponsorship of anyone found guilty. To continue supporting Armstrong at this point may feel like loyalty. But soon, that loyalty will begin to feel more like craven disregard for the integrity of the sport and the wellbeing of its athletes.

I strongly suggest these corporations get out from under this ethical albatross as soon as possible. Their corporate resonsibility is at stake and ultimately so may be their revenue as this story unravels. Imagine what will happen as Tyler Hamilton begins doing Oprah and Jon Stewart as part of his book tour. Smart companies will get off the Liestrong train if they know what is good for them, the sport, and the culture itself.

Under the proposed plan, homeowners facing foreclosure could opt for a mediator ? with the bank paying the bill. Banks wouldn?t have to agree to a deal. They could still foreclose. But they?d face a $1,000 fine if they refuse to mediate or if the mediator felt they acted in bad faith.

In Madison County, the program has put a small dent in foreclosures. Linda Jun, who ran the program until last week, said only 10 to 20 percent of borrowers opt for mediation, although it?s offered to everyone in foreclosure.

Of the 291 who signed up, 61 homeowners reached a deal with their creditors so far, according to court figures. Of those, all but two kept their homes. About 100 cases are still working through the system, so the number of averted foreclosures could increase.

Madison County?s experience seems on par with other mediation programs around the country.

The St. Louis County Council passed its own mediation plan by 5-to-2 on a preliminary test vote on Aug. 14; a final vote is expected on Tuesday. But bankers are mobilizing and threatening lawsuits if it wins final approval.

The bill was introduced by Councilwoman Hazel Erby, a Democrat who represents some inner-ring suburbs where foreclosure rates are high. As of July, 805 homes in St. Louis County were in some phase of foreclosure, according to figures from RealtyTrac.

What if the physician writes down the wrong drug name by mistake, such as prescribing XYZ instead of ZYX? What if the pharmacist misreads the instructions and dispenses YXZ? These are all examples of potential medical negligence. However, remember that the patient must suffer harm as a result of the negligence. If the patient catches the error before ingesting the wrong medicine and no harm results, then a medical negligence claim cannot be fully established.
  4. The loss of a ?chance? ? In cases where a condition has a high likelihood of recovery, such as 50 per cent when discovered promptly, doctors could be held liable if the condition is not diagnosed because of the loss of a chance to recover (House of Lords 2002 Gregg v. Scott).
  5. Failing to obtain consent to treatment ? In general, doctors must obtain consent before treating a patient. If the doctor fails to do so and proceeds with a treatment that causes harm to the patient, the patient may have a legitimate medical negligence claim.
  6. Failing to warn the patient about a treatment?s risks ? Similarly, the physician has a duty to warn the patient of the risks of a treatment. Simply asking the patient to sign a consent form is not the same as discussing the risks involved.
  7. Making a mistake during an operation or procedure ? Imagine going into surgery to have your left foot amputated due to an uncontrollable infection and waking up to find out that the surgeon amputated your healthy right foot by mistake. Medical mistakes during treatments and procedures are a prime example of medical negligence.?

The First Steps

According to Patient.co.uk, if you suspect medical negligence in England and Wales, the Civil Rules of Procedure strictly apply (they do not apply in Scotland and Northern Ireland). The first step involves getting legal representation and filing a letter of claim. The defence is allowed a few weeks to gather evidence and respond. Tropical Storm Isaac lashes Cuba, with Florida Keys in sights

HAVANA (Reuters) - Tropical Storm Isaac, back over warm ocean waters, lashed Cuba with winds and rain as it swept toward the Florida Keys, where it was expected to strike on Sunday as a minor hurricane.

The storm left six dead in Haiti, still recovering from a 2010 earthquake, and at least three missing in the Dominican Republic after battering their shared island of Hispaniola on Saturday.

No deaths or injuries had been reported in Cuba, which got off lightly when the storm crossed its eastern flank instead of raking up the length of the island as originally predicted, but still suffered damages.

Though still 340 miles east-southeast of Key West, it was already causing problems in the United States.

Energy producers in the Gulf of Mexico were shutting in production and the U.S. Republican Party said it would recess its national convention in Tampa, Florida for a day out of safety concerns as the storm bore down on the state.

The storm could force a short-term shut-down of 43 percent of U.S. offshore oil capacity and 38 percent of its natural gas output, according to forecasters at Weather Insight, an arm of Thomson Reuters.

Republicans, who will formally nominate former Massachusetts Governor Mitt Romney as their presidential candidate for the November election, will convene their four-day meeting on Monday as scheduled, then recess until Tuesday.

Tampa, located on Florida's west coast, could feel the effects of Isaac, whose tropical storm force winds extend 200 miles from its center.

In its latest advisory, the National Hurricane Center in Miami said Isaac was 65 miles northeast of the Cuban city of Camaguey and cruising northwest at 17 miles per hour.

Its top winds were near 60 miles per hour, but the center said it appeared to be gathering steam and was expected to be at or near hurricane strength when it reached Key West, 90 miles north of Cuba.

A storm becomes a hurricane when sustained winds reach a minimum of 74 miles per hour.

After passing through the Keys, Isaac was expected to move into the northeastern gulf, add more punch and hit the Florida panhandle or further west as a Category 2 storm with 100 mile per hour winds.

CRASHING WAVES, FLOODING

The Cuban Meteorological Institute warned the storm could do more damage to the communist island because it was expected to run near and parallel to the northern coast all the way into the Florida Straits, which separate the U.S. and Cuba.

Radar showed most of Isaac's powerful rainstorms were north of the island, but eastern Cuba, hit hard on Saturday, was still getting downpours that dropped more than three inches (80 mm) of rain in three hours.

As the storm moved closer to Havana, wind gusts and driving rains intermittently hit the city.

Baracoa, the island's easternmost city, appeared to get the worst of the storm, which sent 13-foot waves crashing over the seawall and into the streets. Cuban TV reports said more than a thousand people had to be evacuated and 50 buildings were damaged.

"The force of the waves has destroyed the farmer's market for small businesses, also the children's area of a park and various homes," said Baracoa resident Olider Aguilera by telephone. "But I can tell you that the people are not afraid. They're accustomed to meteorological phenomena stronger than this," he told Reuters.

In Haiti, Isaac added to the misery of more than 350,000 survivors of the 2010 earthquake still living in flimsy resettlement camps as water gushed into tents and corrugated plastic shacks ripped apart by the wind.

Authorities said six people were known dead, including a 10-year-old girl killed when a wall fell on her and a woman crushed to death by a falling tree.

Many main roads were blocked or impassable and 14,000 people had been evacuated to shelters, they said.

In the Dominican Republic, officials said three people were missing, including the mayor of a town near Santo Domingo swept away as he tried to save another person from a flooded river.

They said 764 homes had been damaged by the storm and more than 9,600 people evacuated from storm-struck areas.

Ecuador says Britain withdraws threat to raid embassy in Assange standoff

QUITO (Reuters) - Britain has withdrawn a threat to enter Ecuador's embassy in London to arrest WikiLeaks founder Julian Assange who has taken refuge there, President Rafael Correa said on Saturday, taking the heat out of the diplomatic standoff.

"We consider this unfortunate incident over, after a grave diplomatic error by the British in which they said they would enter our embassy," Correa said in a weekly media address.

In a statement, Ecuador's government said it had received "a communication from the British Foreign Office which said that there was no threat to enter the embassy."

Ecuador was furious after the British government warned it might try to seize Assange, who has been holed up in the building for more than two months trying to avoid extradition to Sweden, where he is wanted for questioning over rape and sexual assault allegations.

Ecuador, which has granted the former computer hacker asylum, demanded that Britain's threat be retracted. The latest move should improve relations between Quito and London and allow more talks on Assange's fate to take place.

For now, however, Assange remains trapped in the embassy with British police waiting outside. Britain has said it is determined to fulfill a legal obligation to send him to Sweden.

The Washington-based Organization of American States had condemned Britain's threat, and South American foreign ministers strongly backed Correa's position that Britain's warning was unacceptable and could set a dangerous precedent.

Correa says he shares Assange's fears that if handed over to Sweden, he could then be extradited to the United States to face charges over WikiLeaks' 2010 publication of secret U.S. cables.

U.S. and European government sources say the United States has issued no criminal charges against the WikiLeaks founder and has launched no attempt to extradite him.

Ecuador's government says it never intended to prevent Assange from facing justice in Sweden. It has said that if he received written guarantees from Britain and Sweden that he would not be extradited to any third country then Assange would hand himself over to the Swedish authorities.

Assange, whose platinum hair and friendships with the rich and famous have helped make him a global celebrity, spoke from the embassy's balcony last weekend, denouncing what he called a "witch hunt" by the United States against him and WikiLeaks.

Lack of white-flag prosecutions challenges Goldstone belief that #Israel investigates #Gaza killings in good faith.

Maybe you remember that a year ago last spring Judge Richard Goldstone walked back his landmark UN report on human rights atrocities in the Gaza slaughter by stating in the Washington Post that he was satisfied that Israel was investigating the alleged crimes "transparently and in good faith... to a significant degree."

Maybe you remember the several cases that Goldstone documented of women shot while holding white flags and seeking to leave areas of conflict. A war crime, he said.

Well here is the latest from Human Rights Watch on one such white-flag killing, and the Israeli investigation of the case:

A military trial that ended August 12, 2012, failed to hold anyone accountable for the killings of a mother and daughter during Israel?s military operation in Gaza in December 2008 and January 2009, Human Rights Watch said today.

The two women were killed when an Israeli soldier opened fire on a group of civilians holding white flags to demonstrate their civilian status. The case concluded after a soldier pled guilty to ?unlawful use of arms? without any conclusion that the action was linked to the killings. In a civil case, Israeli authorities paid compensation to the women?s families.

An Israeli soldier accused of killing a mother and daughter carrying a white flag in Gaza during Israel's 2009 'Operation Cast Lead' has received a sentence of only 45 days following a plea deal approved by a military court on Sunday.

Rayah Abu Hajaj (in this family photo) and her daughter Majedah were shot while walking with a group of Palestinians holding white flags after their home was bombed during Israel's 'Operation Cast Lead' in the Gaza Strip in 2009. The charges against the soldier -- known only in court documents and the Israeli media as "staff sergeant S" -- were reduced from 'manslaughter' to 'using a weapon illegally'. In addition, as the Israeli human rights group B'Tselem points out, the deal does not recognize guilt for the killing of Majedah and Rayah Abu Hajaj, but rather punishes the soldier for the "killing of an unidentified individual."

"Following a mediation process and upon examination of the evidence with the recommendation of the military court, both sides have reached a plea bargain in which the indictment will be adjusted, and he will be convicted of using a weapon illegally," a military statement said.

B'Tselem challenged the decision and called for the reopening of the case for a full and thorough investigation.

"If the military prosecution accepted the claim brought by the soldier's lawyers, that there is no connection between the shooting he admitted to, and the killing of the Palestinian mother and daughter, this means that the investigation into this incident was never completed," the group said in a statement.

"B'Tselem demands that the Military Police investigation unit reopen the file."

According to B'Tselem, on January 4, 2009, the Abu Hajaj family evacuated their home after it was hit by an Israeli tank shell.

"When they saw tanks about 150 metres (yards) from them, two of them waved the (white) flags, and the children in the group sat on the ground," B'Tselem said.

"Suddenly, and without warning, shots were fired at the residents, killing Majda Abu Hajaj on the spot. Her mother, Riyeh Abu Hajaj, was severely wounded by the gunfire," it said. She later died of her wounds.

The incident was one of those raised in the UN Goldstone Report on alleged war crimes by both Israel during its incursion of the Gaza strip in late 2008 and early 2009.

Real names no longer required online: SK court

(AP)?SEOUL, South Korea -?A South Korean court ended a law requiring Internet contributors to use their real names to leave comments, ruling unanimously Thursday that the policy undermined free speech.

The online naming law took effect in 2007 under a bipartisan push to curb libeling, the spread of false rumors and abusive comments in the cyber space. South Korea saw a flurry of celebrity suicides allegedly motivated by malicious online comments, which mobilized the move to control the Internet space.

The eight judges at the Constitutional Court said the real name policy discouraged people from voicing dissents out of concern they would be punished.

"Expressions under anonymity or pseudonym allow (people) to voice criticism on majority opinion without giving into external pressure," the court said. "Even if there is a side effect to online anonymity, it should be strongly protected for its constitutional value."

The court also said it found no proof that the law helped decrease libel or the spread of rumors and false information.

Under the real-name policy, nearly 150 websites with over 100,000 daily visitors, often very popular destinations for South Koreans, required submission of identity information to leave comments.

The regulation also prompted South Koreans, including popular online pundits and critics of government policies, to find an anonymous refuge in overseas services such as Google and Twitter. Some argued the law discriminated against domestic Internet services.

Observers said a series of security breach that leaked millions of personal data from those websites that adopted real-name policy also factored in the decision.

Others said the ruling, while it is a significant step toward fostering freedom of speech, addresses a small part of broader regulations that are still tightly controlling the Internet space in one of the world's most wired countries.

Even though South Korea has a vibrant democracy and Asia's fourth-largest economy, a batch of laws that regulate the Internet are still in place, critics say.

"Real name policies are still intact in many other places. Teens and their parents should verify their names to play online games and during election campaign periods, no anonymous comments are allowed," at websites of media companies, said Jinbo Net activist Chang Yeo-kyung.

Until recently, South Koreans could be criminally punished for leaving false information online. Before 2012, South Koreans were not allowed to disclose in the cyber space their support or opposition of a political party or a candidate. These bills were ruled unconstitutional in 2010 and in 2011.?

Green Energy Background Check: The U.S. Military Passes the Test

People all over the world respect the U.S. military, but not just for the justice they bring against criminals and enemies of the state. The U.S. military is also famous for their innovations beyond the realm of war; for example, the care to which they give their troops and their contributions to civil engineering are extraordinary.

Some of the U.S. military?s programs might surprise you. The U.S. military offers some of the most progressive and comprehensive health care coverage for their personnel; they also have strong educational incentive programs that help service members and veterans pay for college and vocational schools once they?ve served their country. The military served as the front line for social change during times of segregation, and more recently for gay rights. In other words, the U.S. military is a pioneering institution.

Now the U.S. military is taking the lead for a new era of American energy usage. A recent article in Forbes magazine explains how the U.S. military is planning to became a pioneer in renewable energy. Forbes reports that the U.S. military will open up a whopping 16 million?16 million!?acres of land for various renewable energy projects. The military will develop the land for solar energy, wind energy, and geothermal energy programs meant to establish sustainable alternative fuel resources. The majority of these programs will be researched in the western U.S.?think open fields filled with wind turbines, solar panels, and the like.

The U.S. military has been vying for more sustainable energy solutions for quite some time. The article explains part of their reasoning as the desire to be a more self-sufficient body, one that doesn?t have to rely on refined oil and gas resources in order to complete missions and get the job done. Renewable energy is just a smart decision for the military, because it opens the door to new innovations that could help them sustain the world-class reputation that they?ve maintained for years.

And the military could not pick a better time to voice their support for renewable energy. The renewable energy market has perpetually taken a backseat to fossil fuel extraction, refinement, and distributions in America; our country?s energy market is dominated by oil companies that want to remain profitable in their business. Unfortunately, it?s hard for oil companies to remain profitable if they?re made to compete with renewable energy sources. Excessive lobbying on behalf of oil and gas combined with intense opposition from many in the GOP has caused renewable energy options to stagnate in the U.S.

Hopefully the U.S. military?s investment in clean, renewable energy will serve as a catalyst for private companies to take more interest in the market. Only time will tell.

U.C. report on Jewish campus climate: Results marginalize, misrepresent students critical of Israel

The Israeli occupation of the Palestinian territories has long been a controversial topic in the United States, especially on college campuses. Personal identity can influence how people view the conflict, causing some to assume that this discussion is, or should be, conducted strictly along ethno-religious lines. This assumption, however, has the potential to chill speech and push dissenters out of their communities. As a Jewish and African American student critical of Israeli policy and involved in Palestinian solidarity organizing at U.C. Santa Cruz, I experience this firsthand.

Vpierce_with_nameSince coming to UCSC, my ability to participate in Jewish student programming while active in the campus Committee for Justice in Palestine has met constant challenges. Last year, I was repeatedly subjected to abusive online comments by a staff member at a center for Jewish life because of my decision to be in CJP and participate in Jewish student programming. This is not the only time I?ve been targeted, and I?m not the only Jewish student to experience something like this. Unfortunately, recent steps by the University of California to ?improve campus climate? appear poised to make this situation even worse.

On July 9, U.C. President Mark Yudof?s Advisory Council on Campus Climate, Culture and Inclusion presented the ?University of California Jewish Student Campus Climate Fact-Finding Team Report & Recommendations.? Authored by Rick Barton of the Anti-Defamation League and Alice Huffman of the California NAACP, it is ostensibly based on testimony from meetings with Jewish students at six U.C. campuses. I was part of a Jewish student panel that discussed the report when it was released, and had no choice but to dispute much of its findings.

I was present at the UCSC meeting in fall 2011 and discussed the difficulties of maintaining involvement in both CJP and my campus Jewish community. But upon receiving the report, I discovered my experiences, and those of other Jewish students critical of Israel, were almost entirely absent.

In fact, while the authors note there are some Jewish students involved in what they label ?the anti-Zionism movement,? the document portrays Palestinian campus organizing as problematic, or even anti-Semitic by nature, often through unchecked generalizations.

For example, it states that ?[t]he use of the swastika drawn next to, or integrated with, the Jewish Star of David? is ?commonplace.? Palestinian students and their allies are aware of the meaning and history of that symbolism, and avoid using it; the notion that its use is ?commonplace? at our events is false and offensive.

Even worse, many of the report?s recommendations call for policies that discriminate against speech dealing with Palestinian rights. The first recommendation in the document is that ?UC should review its policies on University sponsorship and neutrality and develop model institutional protocols for such activities.? This proposal is followed by suggestions that the U.C. even consider prohibiting sponsorship of ?Israeli Apartheid Week? events, a term used interchangeably with ?Palestine Awareness? in the report. Several other recommendations also suggest limiting Palestinian speech. None of the proposals call for such conditions to be placed on ?pro-Israel? events ? nor would I urge that.

Equally disturbing is what is missing from the report. Several Jewish students and I gave Barton and Huffman articles written by UCSC students who feel the current Title VI complaint and federal investigation into ?anti-Semitism? at our university is chilling criticism of Israeli policy. Despite this, the authors boldly claim that ?the Team?s conversations with students revealed no such confusion or effort to curtail the First Amendment rights.?

When I attended the meeting at U.C. Santa Cruz in the fall of 2011, I hoped my participation would lead to better understanding of the diverse experiences of Jewish students. While I?m thankful I was given a chance to speak, after reading the final document, I am extremely disappointed. I believe that the authors of the report have failed in their mission to accurately and equitably represent the needs of all Jewish students, and the report is instead a platform to stifle Palestinian organizing on U.C. campuses. This may represent the wishes of some Jewish students supportive of current Israeli policy in Palestine, but it marginalizes and misrepresents many others.

In July I co-authored a letter with other concerned Jewish U.C. students asking President Yudof to table the problematic report and recommendations until a more equitable and accurate study could be completed.

I am glad that President Yudof has responded to our letter (?Report calls for regulating ?hate speech? at U.C.,? Aug. 10). However, many unanswered questions remain about the methodology the authors used in the report and the impact of its recommendations on the Palestinian student organizing that it brands as hate speech.
